Quite true! However, the slight difference here (vs. the sexting cases) is that here the subject of the picture is the only one to ever have possession of the pictures (though admittedly the picture is of the subject when underage). With "sexting" person A receives an underage naked picture of person B. It seems different to me ... though I certainly wouldn't put it past the U.S. courts or legal system to try and make a case of it.

It's a bit of a silly scenario, but it's amusing to consider the implications.
