I dig what your saying, Godspell, I really do. And you are right, but unfortunately when it comes to this kind of thing, the powers that be will almost always favor the cops. I know it's an outrage but it's also something that's really difficult to fight. Our legal system is more crooked than most people think. I'm not saying he wouldn't have a chance at fighting this, but if it were me, I think I would leave it alone for safety's sake.
